After reading this story, I was infuriated.  I was angry for Mr. Banks, who was in tears in the courtroom, reflecting on only God-knows-what happened to him after being sent to prison at a young age.  He was a football star on his way to play college sports at the highest level when the non-incident took place.  Wanetta Gibson (the accuser) ruined Brian’s life, and the system aided and abetted her in a quest to destroy this young man’s future. Every perpetrator of this crime against justice deserves to be punished, starting with Banks’ accuser.  There is word that Wanetta is going to be asked to repay the $1.5 million she was paid by the school district for what she claimed to have happened to her, but her repayment should go far beyond money.  She should be prosecuted to the fullest extent of the law, and deserves a prison sentence no less severe than the time that was going to be given to Mr. Banks when the state chose to believe that he was a rapist. The second person to pay for what happened to Mr. Banks should be the attorney, judge and prosecutors who coerced him into taking a plea deal.  Mr. Banks was told that if he continued to hold on to his “illusion” of innocence and actually fight for his right to a fair trial, he could face up to 41 years.  This kind of threat is similar to what was done during the Salem Witch Trials and the Spanish Inquisition, where anyone who proclaimed their innocence was tortured until they admitted guilt.  This kind of coercive and unjust bargaining should be disallowed in the justice system altogether. Finally, Mr. Banks deserves to be financially compensated.   No amount of money can make up for what he lost, but about $10 million dollars should help ease the pain at least a little bit.  There was no physical evidence whatsoever that Banks committed this rape, so there was no justification for any judge or prosecutor to consider sending him to prison. In that regard, those involved in the decision to destroy this young man’s life should be sent to the very same prison that they were willing to send an innocent human being. The story of Brian Banks is, unfortunately quite common, particularly among young black males.   It has even happened in my own family and the scenario is usually the same:  Someone gets into trouble and can’t afford a good attorney.  The overworked public defender, without seriously considering the evidence, tries to get the defendant to take a plea deal.  Even if he is actually innocent and fights for their right to a fair trial, the defendant is then told that not succumbing to jail or prison time will result in a much harsher sentence.  The person doesn’t go to prison because they are proven guilty beyond a reasonable doubt; they are incarcerated because public officials are too lazy to actually carry out their commitment to pursuing justice. As a result of this farcical form of justice being administered all throughout America, millions of black men can’t get jobs and black families have been destroyed to no end.  Politicians in Washington are asking black folks to march for gay marriage and immigration, but say almost nothing about the fact that our fathers, sons and brothers are being sent away to capitalist-funded modern day, concentration camps.  This is nothing short of a true holocaust, and the broken families, violence and devastation around us serve as evidence that the impact is both deep and permanent. What’s saddest about the story of Brian Banks is that he was one of the lucky ones.   His accuser was silly enough to confess to her lie on record, and someone cared enough to investigate the situation further.  But for every Brian Banks that is exonerated, there are 1,000 other innocent citizens who sit behind bars, away from the people they love.   They were never given a fair trial and no one will ever take up their case.  These stories will never be told. Dr. Boyce: If Someone’s Falsely Accused of Rape, All Liars Should be in Prison

    But plea bargin coerction happen’s in the court room ALL the time.
    I to was coerced into taking a “deal” on a charge that the ‘persecuter’ KNEW was false, but because of my repeated run in’s with him (I suffer from PTSD and was starting drug thyrupy, my behavior or a 4 year period was quite erratic) and his inability to “put me away”. He took the oppurtunity to present me with a no win scenario. Plea guilty to 4th degree sexual assult (for suppositly slapping a girl on the backside)(there were 4 witness who wrote to him and told him the girl made it up) with NO sexual preditor listing, or he would report my arrest to child protective services and have them take my daughter. At the time I was a single dad to my 4 year old little girl.
    I took it, I HAD NO CHOICE… I was poor.
    This “persucuter” was later convicted himself of embezzelment.

  3. Brian Bank’s case is most pathetic, being that he lost ten years of his most productive youthfulness.
    For Wanetta Gibson, i’m sure there was one kind of a relationship between her and Brian that went sour; and at this point, i won’t advocate punishment for her, reason being that there are millions more of her out there who would do the same and are gearing to cimmit many falsely, but an open window of non-punishment for such would encourage repentance, abstainance and the audacity to come forward to confess and free the victim.
    Much of the blame should go to the Jury who make such convictions without proper investigation like laboratory tests to ascertain to truth. Also, rape cases unreported within 24hrs should be treated with caution, because the victim would have been framed up.
    As a way out of this case, i want to suggest that Wanetta Gibson not be asked to make any refund to any authority, as repercussion would have caught up with her already, except findings show she has the financial wherewithal to make sunch refunds.

When has a man ever received such an incredible gift…NEVER There are plenty of men serving time because they are unable to pay child support. Just goes to show the inequity and injustice of the CS system stacked against men, while favoring women. About three years ago a woman tried to set-up a friend of mine with a false claim of rape. The only way he was able to get out it he showed the officers- while standing in his living room a video recorded the previous night showing the two of them along with another woman drinking alcohol and playing strip poker. Police did not take him into custody or file charges bc they knew it was bullshit. CYA- put it on tape.

  5. Gibson is trash, and she will never amount to anything. She is a welfare queen and a burden on society. No one gives a crap about her anymore. She is probably sitting in her apartment alone with her nappy headed kids.
    She will probably just get used for sex, and raped multiple times, because no jury would ever convict anyone man who rapes her. A defense attorney fresh out of a run of the mil law school would be able to beat the prosecution.

    Guys, look at it this way… She can get raped, and no jury would convict the rapist. It’s free nasty vagina.

Fools like you should keep your mouth shut when you don’t know what the hell you’re talking about. Maybe it should have been you that was falsly accused and sent to jail, and see how much you’d be running your mouth and saying all of this crap. You would wnat someone to believe you. In your case, it would have been better if you’d remain silent and thought a fool then open your mouth and remove all doubt!!!!

  9. What that woman did was PERJURY and she should be prosecuted. Not only should her money be recovered but it should be transported to Mr. Banks. Wanetta Gibson belongs in jail and ANY woman who knowingly does acts like that, regardless of race or ethnicity deserves to be incarcerated themselves.

  10. @ Dr Boyce, your words are soooooo timely and soooo needed right now! You have hit the points on the head! I disagree with only one thing you said and that is thousands of other’s stories won’t be told,YOU are telling it now thru your Blog!

    The Innocent Project takes on these cases and obviously can’t do it all but if we as Justice Seekers demand funding/dollars be given for the expansion of The Innocent Project or Develop an agency or whatever it takes to address issues specific to those you speak of above the wrongfully accused, or no money for proper representation, or lazy law officials,etc., the thousands you speak of will not be forgotten and will get the Justice they too deserve!

Carry it to your grave. (I’m almost certain that he did something to deserve it) She could still be basking in the joy of his misery if she had just kept her fingers off that keyboard.

What a relief in that the old and tired “Barack Obama/Bill Cosby” MO of talking down to or blaming everything on Black Fathers, the black males or men is neither true or appropriate in this instance, because the wrong doing stems from the actions of a “no good sleazy snake in the grass” black woman.

    In this instance the downfall of Brian Banks is all the fault of Wanetta Gibson, a habitual lying black woman, whose greed to have money derived through deceit had a higher priority than telling the truth.

Had Wanetta Gibson, a lying black woman not have falsely reported that she had been raped, there would not have been any need for the unwarranted penal incarceration of Brian Banks, litigation, criminal indictment, the jailing of Brian Banks by the Long Beach Police Department, any need for the services of any Long Beach City Prosecutor, court appointed attorney, and finally adjudication in the Los Angeles County Superior Court Criminal Court system.

This trifling behing woman should spend time in Jail, along with everyone else involved in the poor guy’s prosecution, his so-called Lawyer, Prosecutor and the Judge. The coerced him into basically surrendering his life. He should be paid BIG TIME for this gross miscarriage of Justice, and it nakes you seriously wonder how many other young men with potential as this young man had, and was robbedof it, are in the same boat. It’s about time Laws are enacted making Judges and Prosecutors liable for what is clearly gross negligence in this case, only then maybe they will use their brains for what God gave it to them.

    • This is why we need to have our own businesses so we can employ our own people, like how we used to do. We need to be more independent instead of being dependent on those who hate us. We should also bring our case, as a people, to the World Court.

      Back in the day, white women used to cry rape and accuse a Black man of the crime, and white people would wipe out Black towns and kill Black men, women and children for this. Remember during slavery and long after, white men used to rape Black women all the time, and what did they get for it? They did this as a people, all the time, to such an extent that the US government had to create a law that stated that children born to a white man and an enslaved Black woman took the status of the mother. This is how much they did that to us! And this woman wants to lie and put an innocent man in jail! After all Black men have been through with this, she really needs to do time herself.

  20. There will be no justice in this case until te accuser pays society the same enough of time plus more FOR LYING and taking this mans freedom and dreams away. THis will allow for others to see what will happen to them if they try the same thing. Brother, enjoy your freedom and money owed to you. Praise God for the things He has done and on tha glorious day I am sure HE will have the answer to why you had to suffer so! So sad but I am so happy for you! Think of all the others accused and still sitting. My son is for one on a crime he did not commit. He ben down 13+ years thus far!

      Just a quick history lesson that needs to be stated: Black people are the original peoples on all continents including this one. California is named after a Black Queen, Califia. (See “Hidden Colors” DVD and do your own research). The Mexican mestizos are mixed Native American and WHITE. There were no white people on the continent prior to Columbus. The REAL, pre-Columbian Native American was a mixture of Black and people of Asian descent. Mexico is a colonial country just like the US and the issue of the land the US ‘stole’ from Mexico is a theft of land from one colonial power to another. Both countries stole land from the Native Americans. Mexican mestizos killed the Apaches, which resulted in Geronimo’s fierce fight back. Look at the history of Guatemala, as recent as the 1990′s. The native people there made a distinction between themselves and “Latinos” (mixed mestizos) because the Latinos were killing the Native Americans there. Research Rigoberta Manchu. The mestizos have white blood. They are not pure Native American at all. Learn your history, Black folks. They will take advantage of us because we DON’T know our history. Now, back to Brian Banks, that woman needs to do some jail time herself for lying and destroying this man’s life. She should not be able to just say ‘oops, I lied’ and then walk free. An example needs to be made of her to (hopefully) deter other women of doing the same thing. Rape is a horrible crime and someone crying ‘rape’ falsely hurts those who have endured such a horrible thing.

  22. Brian Banks would not have a legitimate legal claim for redress to sue the City of Long Beach, the Long Beach Unified School District, the Long Beach Police Department, etc., etc.

    The only individual(s) that Brian Banks can sue for the hardships endured, defamation of character, penal incarceration, etc., etc., would be Wanetta Gibson, any of her family members who conspired with her, etc., for lying under oath…..that is if these individuals have anything left of the multi-million dollar court award for suing the Long Beach Unified School District.

    It would not surprise me in the least to learn or to read that the Long Beach Unified School District sues Wanetta Gibson, any of her family members, for the return of assets acquired under false pretenses.

Mr. Banks has suffered so much and I am happy that he has been exonerated but his accuser as well as the judge and attorney who represented him should all pay for this injustice! The power of Facebook! She actually wanted to “friend” him? Well thank God she did. She should be forced to return the 1.5 million dollars she received as well as be prosecuted herself. Disgusting!!!

  24. As a female, a Black female I am disgusted by this. We already know what happens to accused rapist when they are sent to prison. They are often harassed, raped, beaten, and sometimes killed in prison. No amount of money can heal what that young man went through, we will never know. That vindictive Black b*tch needs to be … ugh, let me stop here before I say some thing that don’t need to be said. Wanetta Gibson is a prime example of the Black woman I can’t stand to be around … liar, vindictive, without a conscious, a plain ol’ I just don’t give a damn kinda attitude. She is the epitome of the why women, especially Black women aren’t taken seriously when we are victimized. She is a threat to the Black community because she has destroyed a man’s life. If I were in charge, she would be sterilized.

Just remember after slavery, trailer park used to lie and have black men hung from trees because they were such sluts and was not getting attention from their hateful wacko men! Years ago, I knew of a similar incident where my friend was falsely accused of a sexual crime that was not true, but because he had a dumb rascist lawyer that did not care because my friend could barely afford to pay, he was railroaded and went to jail for a year! The whore that lied on him was a child abuser herself and my friend should have counter sued and put her low self esteem giraffe looking but in jail, but he didn’t! Please, think about what you are saying and try not to generalize because each situation is different! I am a black women, and I stood by my friend, even when he was in jail, THANK YOU VERY MUCH!

        If you reread her statement, I don’t believe that there was a generalization about Black women as a whole. It was a comment regarding the selfish, vindictive and utterly cruel acts perpetrated by wanetta gibson (I will not give her the respect of a proper noun). In all honesty, this is one of the many reasons why as a Black Man, I can say that in today’s world of “female empowerment”, I am afraid sometimes of what to say to a woman because I might be accused of something that was never a part of what I intended to say or do. Mr. Banks not only had his life torn apart, but risked because some silly B*tch decided to “get hers” at the cost of someone else’s freedom and life. What makes this story all the more infuriating is the fact that she was paid. No offense to actual rape or molestation victims, however the way things are handled as of current are seriously undermining the very fabric of relationships between men and women.

Prosecutes in particular need to be rained in. in too many instances even after overwhelming evidence of innocence prosecutors refuse to relent for fear of blemishing their conviction rates. This kind of arrogance and callous disregard for the lives of others should come with harsh punishment that includes disbarment and prison.
